This Agreement shall be governed by and interpreted according to the law of Lithuania and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Lithuanian courts.
Commissions, Purchases and Returns Policy.
Payment and Billing.
We use Stripe and Paypal as our payment system providers. Our Terms are payment in full before the item is dispatched. All goods remain the property of the Company until paid for in full. We are not able to change billing details on invoices once an order has been submitted. Please be sure to enter your correct details when initially placing an order.
E-shop Returns.
You have 14 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging. Your item needs to have proof of purchase and the ‘‘Individual product certificate’’.
Individual product certificates are provided with every item sold through Studio Michael Mccready and proves authenticity. Failure to return this certificate will deem the product nonrefundable.
Commission Cancellations and Refunds.
When you make a custom commission we tailor the product to your exact needs a specification, we therefore cannot offer a refund in the same way we do for normal E-shop products.
However we do offer you protection throughout the commission, you will see that this consists of the following steps
Step 1 - initial specification and development - 20% of the payment is non-refundable
Step 2 - Product production - 60% of the payment is non-refundable
Step 3 - Finished and shipped product - 100% of the payment is non-refundable
Commissions will be subject to a 60% prepayment, with 100% payment required prior to shipping.
Refunds.
Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item. If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer's policies.
Shipping.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable. If you cannot organize we can arrange for collection and the cost of return shipping will be deducted from your refund.
VAT/PVM.
If you are a VAT registered business outside of Lithuania but in the EU, then you may be eligible for VAT/PVM exemption. To see if you qualify for this you will need to provide us with proof of a valid VAT/PVM certificate and complete business details.
If you are located outside of the EU, contact us to remove the VAT/PVM from your order before you complete your purchase. We can’t refund the VAT/PVM after a transaction is complete.
FORCE MAJEURE.
Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.
